UAE Overhauls VAT Rules: Large Cash Payments and Staff Housing Face Tighter Tax Recovery Tests

Amended executive regulations taking effect on October 1 curb input tax recovery on cash settlements above pending ministerial limits, while standard staff accommodation loses automatic deductions unless mandated by MoHRE.

DUBAI — Companies across the United Arab Emirates face tighter scrutiny on tax deductions starting October 1, 2026, under sweeping amendments to the UAE VAT Executive Regulations that restrict input tax recovery on major cash settlements and alter the tax status of employee benefits.

The regulatory changes target two routine corporate practices: settling invoices in physical currency and reclaiming VAT on employee accommodation. Under the revisions, businesses will be barred from recovering input VAT on purchases above a specified financial threshold if the settlement is made, or intended to be made, in cash. The Ministry of Finance is scheduled to issue a separate ministerial decision specifying the exact monetary ceiling and administrative controls.

Tax practitioners note that the wording of the amendment places the focus on the value of the underlying supply rather than merely the cash portion handed over. If a business splits a major payment or settles only part of an invoice with cash, input tax recovery on the broader transaction could be jeopardized depending on final execution guidelines.

Retail operations, food and beverage groups, site petty cash desks, cash-on-delivery platforms, and construction subcontractors handle significant physical currency. Senior market analysts point out that companies should transition transactions into traceable, auditable digital channels—such as electronic fund transfers, corporate credit cards, or direct bank clearing—to prevent standard five percent VAT outlays from becoming permanent operating expenses.

Labor-intensive industries such as construction, facility management, logistics, hospitality, manufacturing, and oilfield services must also overhaul their workforce overhead calculations. Previously, employers routinely recovered input tax on labor accommodation, worker camps, and housing stipends under general provisions of the UAE labor law.

The amended executive regulation severs staff housing from the general labor law route. Moving forward, input tax incurred on employee accommodation qualifies for recovery only if the facility is explicitly mandated by formal directives or decisions from the Ministry of Human Resources and Emiratisation (MoHRE). Where accommodation is provided voluntarily, or solely as a competitive employment perk without a direct statutory MoHRE mandate, the associated VAT cannot be reclaimed.

Non-housing employee benefits—such as medical allowances, staff transportation, or wellness perks—remain potentially recoverable if anchored in written employment contracts or documented internal human resources policies. Recovery remains conditional upon criteria and thresholds that the Federal Tax Authority (FTA) will outline in supplementary guidance.

Corporate tax and legal teams have a narrow window before the October 1 launch to cross-reference their payroll terms, supplier payment routines, and camp operating leases against MoHRE standards.

A secondary structural reform is slated to take effect later. Businesses generating both taxable and exempt turnover face a revised standard apportionment calculation for input tax recovery, which takes effect from the start of the first tax year beginning after October 1, 2027. That mechanism will measure the value of supplies eligible for VAT recovery against total corporate revenue. Government bodies and registered charitable entities will remain under a distinct input-based calculation model.

Contracts packaging goods and services together also fall under revised single composite supply regulations starting this October, compelling suppliers to review multi-tiered commercial contracts before issuing final invoices.
